Terms and Conditions
1. General provisions
1.1 These general conditions define, without prejudice to the application of special conditions, the respective obligations of the contracting parties on the occasion of sales made by our services.
1.2 By signing the agreement or the order form or by accepting the order confirmation, our co-contractor expressly acknowledges having read these general conditions and having accepted them.
1.3 The provisions which are not expressly derogated from remain applicable. Only exemptions that are the subject of a written agreement on our part can modify the application of these general conditions.
1.4 In the event of conflict between the general conditions of our co-contractors and ours, it is agreed that the latter will prevail.
2. Validity of flight coupons
2.1 Flight coupons are valid for 12 months from the date of order. After this time, they are cancelled. The date of the simulation may be later than the expiry date of the coupon as long as the appointment is made before the expiry date.
Example: If your flight coupon was purchased on December 21, 2018, then it will be valid until December 21, 2019. You have until December 21, 2019 to make the reservation. The reservation can be made in 2020 after the expiration date.
2.2 Flight coupons are only valid for the pack as described. The coupon can however be exchanged at the time of booking by paying the difference between the price of the new pack and the value of the coupon.
2.3 The day and time of the flight reservation can be changed free of charge, no later than 48 hours before the booked flight, by calling the center EUROPEAN FLIGHT SIMULATOR. In this case, the expiration date of the flight coupon remains unchanged.
2.4 In the event of a no-show for the booked flight occurring in the absence of a cancellation or modification of the reservation within 48 hours, the flight coupon will be canceled without the possibility of reimbursement.
2.5 Flight coupons cannot be reimbursed under any circumstances.
2.6 By way of derogation from point 2.5, any buyer has a right of withdrawal under which he has the right to notify EUROPEAN FLIGHT SIMULATOR that he renounces the purchase without giving any reason, within 14 calendar days from the day after the day of the conclusion of the service contract, that is to say concretely from the day after the day he receives by email the flight coupon.
10 euros administrative costs will be automatically deducted from the reimbursement.
The existence of this right of withdrawal of the consumer is subject to the conditions of articles 46 and 47 of the law of April 6, 2010 on market practices and consumer protection.
In accordance with article 46 § 4 of the law of April 6, 2010, the consumer cannot appeal to this right of withdrawal if the execution of the provision of service has started, with the consumer's agreement, before the end. the 14-day withdrawal period.
Any exercise of the right of withdrawal must be reported in advance by registered mail to the head office ofEUROPEAN FLIGHT SIMULATOR.
When the buyer has validly made use of his right of withdrawal, he will be refunded within 30 working days.
2.7 A lost flight coupon can only be replaced upon production of proof of payment.
2.8 Special and temporary offers relating to certain flight coupons are only valid during the specific specific period indicated by the terms of the offer.
3. Extension of flight packs
The buyer or the beneficiary of a flight coupon has a maximum of three months from the expiration date of his coupon to extend its validity by 12 months thanks to our extension pack.
The 12-month extension begins on the expiration date of the gift voucher and not from the date of purchase of the extension pack.
Please note, a flight coupon can only be extended once.
Example: If you bought a pack on December 21, 2018, then it will be valid until December 21, 2019. You have until March 21, 2020 to extend the validity of the pack. You will then have until December 21, 2020 to book your flight.
4. Flight times, duration and quality of the flight
4.1 The flight times fixed for our services are given, unless otherwise specified, for information only.
4.2 In the event of a delay of more than 60 minutes in relation to the time fixed for information on the flight coupon, the latter will be replaced free of charge by an equivalent flight coupon.
4.3 If the duration of the flight is reduced by you, you will not be able to request compensation or reimbursement, even partial. The reasons which are attributable to you, without these being exhaustive, include your late arrival at the flight center, the request to take a break, the feeling of air sickness or any other physical problem during the flight.
4.4 If we encounter technical difficulties during your flight resulting in a reduction in the quality or duration of the flight, it will be replaced free of charge by an equivalent flight coupon.
4.5 We make every effort to give you a USB key once your flight is over. In the event that it is not technically possible to give it to you at the end of your flight, we will send it to you very quickly by post. If for technical reasons we cannot provide you with the ordered USB key, even at a later date, we will refund the value of this purchase, without further compensation.
4.6 The sole purpose of the flight simulator is to offer fun activities. EUROPEAN FLIGHT SIMULATOR is by no means a certified pilot training company.
5. Safety and accessibility to the flight simulator
5.1 For security reasons, an identity card must be presented before entering the simulator. We reserve the right to refuse your admission if you are unable to produce an official document including your photo. In this case the flight coupon will be canceled and not refunded.
5.2 The minimum age to access our simulator is 12 years old, there is no maximum age. The minimum height required is 1,50 m.
5.3 The flight simulator is an exact replica of an aircraft cockpit. It requires sufficient mobility in order to enter and exit the device and may not be suitable for some people. Please contact us during your purchase if you believe your physical condition is likely to affect your experience. The use of the flight simulator can produce effects which vary from one individual to another. It is your sole responsibility to verify that you are physically able to use the flight simulator.
5.4 Access to the flight simulator will be refused if we determine that you are under the influence of alcohol or drugs or if you appear to be physically incapable of using the flight simulator. In this case, the coupon will be canceled and not refunded.
5.5 By your purchase or by using your coupon for a flight simulation session, you implicitly agree to indemnify EFS, its employees and collaborators, for any action on your part that would directly or indirectly cause damage, costs or expenses of any kind.
6. Price
The fixed prices are denominated in euros, VAT included.
7. Payment of invoices
7.1 Invoices are payable at our head office, at the latest within thirty days of their dispatch. After this period, any unpaid invoice will produce, as of right and without formal notice, a contractual interest of 12% per annum, with a minimum rate in accordance with that provided for by article 5 of the law of 2 August 2002 relating to late payment in commercial transactions.
7.2 Any unpaid invoice on the due date will also be increased, automatically and without formal notice, by a fixed and irreducible indemnity of 15% of the amount remaining unpaid with a minimum of € 50.

7.3 Any dispute relating to an invoice must reach us in writing, within fifteen days of its sending.
8. Disputes
In the event of a dispute between the parties or a payment suit, the Courts on which our head office depends.
9. Changes to the agreement
Any change in the specific agreements or the present general conditions must be the subject of a written amendment signed by all the parties.
10. Salvation clause
The invalidity or illegality of one of the clauses provided for in the contracts (specific and general conditions) agreed between the parties in no way entails an invalidity or nullity of the other conditions of the contract concluded between the parties - clauses remaining fully valid.
